The Failure of the 28-Article Peace Initiative for Ukraine: How Peace Negotiations Continue to Stumble

Europe experienced widespread relief on Monday, as the diplomatic emergency triggered by the introduction of a new 28-article proposal for resolving the conflict appeared – momentarily – to have been contained. A American diplomat spoke of "significant advancement" after diplomatic discussions in Geneva. On Monday night, Russian leadership made its retaliation: another massive barrage of aerial bombardment on Kyiv.

The Rhythm of Diplomacy and Destruction

The succession of conflicting incidents captured the bleak nature of the outgoing year. By day, negotiation efforts are fought: hopeful statements are issued from different nations. Significant resources is allocated on containing certain initiatives. By night, Moscow forcefully demonstrates the world that, for them, military action persists as the key method for achieving "peace".

Nighttime Reality

As Russia's attack developed into the early hours of Tuesday, the present situation of Ukraine's defenselessness was revealed. Ukraine is able to track projectile deployments from enemy soil, a capacity provided through timely intelligence. From witness perspectives, Ukrainian air force fighter jets that had been dispatched to engage hostile cruise missiles flew past – modern combat jets supplied to Ukraine by European allies.

Soon thereafter, Kyiv's missile defense activated: multiple launches targeted at a hostile projectile. This was a advanced protection mechanism at work, most likely delivered by allied countries. Every deployment shakes the surroundings, rattling buildings. The instant of fear quickly gives way to sober acceptance: maybe the hostile projectile won't hit its mark this time, sparing the city from devastation and further power outages.

Continuous Dangers

Following this, a heavy machine gun fired at a aerial vehicle in the vicinity, part of a defensive team – probably Western-made equipment. Sadly, the shots failed to hit the enemy aircraft – it maintained course toward its objective.

With pauses, this carried on until dawn. Kyiv awoke to the morning news: several casualties, damage and infrastructure problems in multiple buildings as a result of the evening attack. As customarily, everyone still went about their day – experiencing conflict. But those entire period demonstrated Ukraine's vital need on international aid – a reliance that neighboring countries are clearly incapable to replace in the near term.

Failed Diplomacy

The comprehensive proposal from Washington provoked deep reactions, debate and deep concern – and briefly redirected concern from Ukraine's largest corruption scandal in years. Yet, we have seen this script before, after prior negotiation attempts and international summits.

Every new initiative from US leadership unfolds according to the identical sequence: a diplomatic cavalry charge against Ukraine, which Kyiv, with other European capitals, effectively counters. They manage the tension but never actually win the battle. This cycle will, undoubtedly, endure.

Tactical Assessments

It is tempting to accuse specific actors of persistently promoting Russian terms. But that does not seem to be the complete picture. US administration functions according to a assumption well known to experienced diplomats: you cannot achieve through diplomacy what you have lost on the battlefield. The American government assumes that it is impossible to pressure the Kremlin to surrender the land that it already controls in Ukraine's southern or eastern regions.

The challenge is that while acknowledging this situation, American administration does nothing to prevent Kremlin actions, through diplomacy or military means, from believing that the status quo will not shift further in its favour in the coming year.

Opposing Positions

Therefore, Russian leadership is confident that the clock favors them – that Ukraine and its partners are coming close to fatigue. Their incentive to agree to terms that does not give them the largest achievable advantage is virtually nonexistent. There may be many attempts to stop fighting, but they will carry on as long as Russia's leader remains highly assured in the conclusion.

On the contrary, Ukrainian leadership believes that Ukraine can still hold out, gradually sacrificing people and territory but avoiding a complete military breakdown until circumstances change in its benefit.

Present Conditions

Factually, there are no actual prerequisites for a ceasefire. Now, subjective factors are coming into play: personal goals to negotiate peace and obtain worldwide acknowledgment, and Ukrainian leadership's dual difficulties – on one hand, not to estrange crucial supporters, and on the other, to rally Ukrainians around the national cause against any plan Kyiv finds unacceptable, so that their attention does not move to internal issues. And although their objective will now be considerably more difficult after current events, it remains quite doubtful that this will modify their basic position.

These opposing factors are influencing discussions.

Summary and Prospects

It took a mere seven days to terminate the proposed articles of the current initiative. Assertive and inconsistent approach of the matter by American leadership, pushback by Ukraine and the remaining European nations, along with pacifying measures of representatives, and finally, recent disclosures, all served their function.

While new proposals based on previous concepts are forthcoming, Kyiv, London and other European capitals should reach an essential realization: Ukraine and Europe will only be able to counter diplomatic offensives from Washington that are based on Russian demands and show certain reluctance to modify developments, if they maintain solidarity and enhance their military capacity at a much faster pace. If they do, neither external pressure nor military threats will be able to overcome them. In the meantime, Ukraine's capability to repel nightly air assaults will, for the predictable period, mainly require sustained allied backing.
